Menard City Council meeting minutes for regular meeting September 12, public hearing on FY 2022-2023 budget, and public hearing on ad valorum tax rate
As submitted by Dorcy Swindall, City Secretary STATE OF TEXAS: KNOW ALL MEN BY THESE PRESENTS: The Regular Meeting of Menard City Council was called to order by Mayor Barbara Hooten at 5:32 P.M. on September 12th, 2022; with the following members present: Mayor: Barbara Hooten, Councilwoman: Collyn Wright, Councilwoman: Genevieve K. Hough, Councilman: Dean Mayhew, Councilman: Tyler Wagner, Councilman: Bob Brown, City Administrator: Don R. Kerns, City Secretary: Dorcy M. Swindall.
Called to Order: 5:32 P.M. Guest Include: Cherry Swindall of MIDC, Cody Lewis, and Lisa Lewis, prospective owners of Mission Theater.
The Pledge of Allegiance, Texas Pledge and Invocation were given by Mayor Hooten.
Public Hearing on FY 20222023 Budget: Called to order at 5:32 P.M.
Public Hearing on Ad Valorum Tax Rate: Called to order at 5:32 P.M.
Approval of Minutes: After a few moments a motion was made by Councilman Brown to approve the minutes for the regular meeting on August 15th, 2022 as well as the Special Meeting on August 8th, 2022 second by Councilman Mayhew. Motion carried unanimously. 5-0
Citizen Comments: None
Accounts Payable and Financial Reports: After further discussion a motion was made by Councilman Wagner to approve all bills with the exception of Wagner’s Tire & Auto as well as Bob Brown (for repayment of Presidio banners he had made) a second made by Councilwoman Hough. Motion carried unanimously. 5-0 A motion by Councilwoman Wright and a second by Councilman Mayhew to pay Wagner’s Tire & Auto as well as Bob Brown. Motion carried 3-0, with Councilman Wagner and Councilman Brown abstaining.
Approve MIDC Sale of Theater: Cody Lewis, and Daughter Lisa Lewis are to be the new owners of The Mission Theater. They shared with the Council some of the plans they have in mind and were eager to get started. A minute later a motion was made by Councilman Wagner to approve the sale of the Theater, Second by Councilwoman Hough. Motion carried 4-0, with Councilman Mayhew abstaining.

Public Hearing on Ad Valorum Tax Rate: Closed at 6:06 P.M.
Amend MIDC FY 2021-2022 Budget: Cherry Swindall presented the facts about the budget and a motion was made by Councilwoman Hough and second by Councilwoman Wright. Motion carried 4-0, with Councilman Mayhew abstaining.
Approve MIDC FY 20222023 Budget: A few minutes later a motion was made by Councilwoman Hough to approve the MIDC FY 2022-2023 Budget, a second by Councilman Brown. Motion carried unanimously 4-0, with Councilman Mayhew abstaining.
Amend City FY 2021-2022 Budget: After discussion a motion was made by Councilman Wagner to Amend the City FY 2021-2022 Budget, Second by Councilwoman Hough. Motion carried unanimously. 5-0 Approve City FY 2022-2023 Budget: Moments later a motion by Councilwoman Wright was made to approve the City FY 2022-2023 Budget, Second by Councilman Brown. Motion carried unanimously. 5-0 Adopt Ordinance Setting Tax Rate: A motion was made by Councilwoman Hough, “I move that the property tax rate be increased by the adoption of a tax rate of $0.54500, which is effectively a 3.00% increase in the tax rate.” Second by Councilman Mayhew. Motion carried unanimously. 5-0 Adopt Garbage Rate: After further discussion Councilman Brown made a motion to adopt and accept the new 3.00 % rate increase (per contract) from Republic Services for them continuing to serve Menard Texas. Second by Councilman Mayhew. Motion carried unanimously. 5-0 Approve and Vote on TML Health Board Member: A minute later a motion was made by Councilwoman Hough and a second by Councilman Brown to vote on Stephen Hanes as TML Board of Trustee. Motion carried unanimously. 5-0 Approve and Vote on TML Risk Pool Board of Trustee: A motion was made by Councilman Mayhew to vote on all Incumbents for TML Risk Pool Board of Trustees, second by Councilman Wagner. Motion carried unanimously. 5-0 City Administrator’s Report: Mr. Kerns reported to the Council that we have been out fixing a few water leaks. We have slowed on fixing pot holes as we have been trying to get all the mowing done. Once the mowing has finished we will continue to work on pot holes. We start putting up Christmas lights in October due to the overwhelming amount that we received this year. So we are looking forward to how the park is going to be lit up the Holiday Season.
Old Business: No old business at this time.
Discuss and Approve helping The Spanish Heritage Days (Financially): A motion was made by Councilwoman Wright to help The Spanish Heritage Days with a 500.00 Sponsorship, second by Councilman Wagner. Motion carried 4-0. With Councilman Brown abstaining.
The next Council meeting be on October 17th, 2022 at 5:30 P.M. Council agrees.
